TERMS OF PARTICIPATION AND DATA PROTECTION NOTICE

Autohaus Anders GmbH, Karl-Friedrich-Benz-Str. 7, 49377 Vechta, Germany, is the organizer of the competition. By participating in this competition, you expressly acknowledge the following conditions and agree to the use of your personal data as described in Section 5.

For better readability, the term “winner (m/f/d)” is abbreviated to “winner” in the following text. Autohaus Anders GmbH is stated as the “organizer” in the following text.

1. Process
The competition runs from December 2nd, 2021 (7:00 p.m.) to December 19th, 2021 (midnight)

You can take part in the competition by subscribing to our newsletter.

The winner will be contacted every Monday at 12:00 p.m. on the email address provided.

2. Profit
After the competition period has ended, the winners will be determined by lottery/random generator from among all participants who effectively take part in the competition according to the terms and conditions of participation and will then be contacted by email using the email address provided
The right to win is neither transferable nor is a cash payout or exchange of the prize possible.

3. Announcement of prizes, feedback or transmission of prizes
The winners will be informed by email within 24 hours of the end of the competition period. Winners must respond by email within 24 hours of notification and inform the organizer of their size and address.

If a winner does not respond by the deadline, a new winner can be drawn in his place from among the remaining participants using a lottery/random generator.

4. Participation
You can take part in the competition by registering for our newsletter and accepting the confirmation email.

All persons with unlimited legal capacity who have reached the age of 18 at the time of participation and are resident in Germany are eligible to participate. No winnings will be distributed to minors who still participate.

The organizer is not liable for late or incomplete receipt of the comment and in particular cannot be responsible for technical disruptions, e.g. B. be held responsible for failures of the telephone network, the network, the electronics or the computers.

Participation in the competition is free and only possible if you have subscribed to the newsletter.

The organizer is entitled to exclude individuals from participation if there are legitimate reasons, such as: B. a violation of the conditions of participation, multiple participation, (attempted) manipulation, etc., and reserves the right to take legal action.

Further, all entries must be made directly by the person participating in the Promotion. Incomplete or illegible entries, entries made by or through third parties or syndicates, entries made using macros or other automated methods (including programmable entry systems) and entries that do not fully comply with the requirements of these terms and conditions will be excluded from participation or not taken into account.

If it turns out that a participant is using one or more computers to circumvent these provisions, for example by using "scripts", the "brute force" method, concealing his or her identity by manipulating IP addresses, randomly guessing codes or any other automated means intended to increase the number of his or her entries to this Promotion in a manner inconsistent with the spirit of this Promotion, that person's entry will be disqualified from participation and any winnings, if any, will be voided.

By participating in the competition, the participant accepts these terms and conditions of participation.

5. Warranty / Liability
The organizer assumes no guarantee for the prize unless there is a case of fraudulent fraud.

The organizers are not liable for damages due to technical malfunctions, for delays or interruptions in transmissions or for losses, costs or damages in connection with participation in the competition, unless the organizers act intentionally or with gross negligence. This does not affect any claims for compensation due to product liability and injury to life, body and health as well as those of essential contractual obligations, i.e. those obligations whose fulfillment is essential for the proper execution of the contract and whose compliance is essential for the contractual partner.

6. Other
These terms and conditions are subject to the relevant German law in Germany, with any disputes regarding the reading of these terms and conditions being subject to the exclusive jurisdiction of the German courts.

The organizers reserve the right to change these conditions of participation if the change is necessary and reasonable for participation, taking into account the interests of the organizers. If the participant does not object to the change within the deadline set by the organizer, the change is deemed approved. The organizers will inform the participant of the circumstances in the change announcement.

The organizers reserve the right to cancel the competition for important reasons. Termination for an important reason can occur in particular if proper implementation of the competition can no longer be guaranteed for technical or legal reasons. If the event is cancelled, there are no claims against the organizers.

Legal recourse is excluded.

7. Declaration of distance

All questions, comments or complaints about the campaign should not be directed to Instagram, but rather to the organizers, for example at marketing(at)auto-anders.de.

8. Severability clause
If individual provisions of these terms and conditions of participation are invalid or there is a gap in the regulations, this will not affect the effectiveness of the remaining provisions. The ineffective or missing provisions will be replaced by a provision that comes closest to the purpose of the contract and the legal provisions.

9. Place of jurisdiction / applicable law
In the event of disputes, German law applies exclusively. The place of jurisdiction is, to the extent permitted by law, the registered office of Autohaus Anders GmbH.

10. Data protection notice
Autohaus Anders GmbH stores personal data in accordance with legal regulations and exclusively for the purposes of processing this competition (legal basis: Art. 6 Para. 1 Letter F) of the General Data Protection Regulation EU 2016/679). The winner's last name, first name and email address will be recorded and stored solely to verify eligibility. You can object to the use and storage of your personal data at any time without giving reasons. All you need to do is send an informal email to: marketing(at)auto-anders.de. In the event of cancellation, further participation in the competition is no longer possible.

Your rights in relation to personal data:
You are entitled, among other things, (i) to check whether and which personal data Autohaus Anders GmbH has stored about you and to receive copies of this data, (ii) the right to add or delete your personal data that is incorrect or not legally compliant are processed to request (iii) to require us to restrict the processing of your personal data and (iv) to object to the processing of your personal data in certain circumstances, (v) to request data portability, (vi) in Germany at the German data protection authority (for further information, see www.bfdi.bund.de/DE/Home/home_node.html ) to lodge a complaint.
